Coverage

Owl Vans, LLC (“Owl”) warrants its internally manufactured parts (bearing the Owl logo) against defects in materials and workmanship for a period of thirty-six (36) months from the date of purchase, subject to the terms and conditions outlined in this Limited Warranty. This Limited Warranty covers only the original purchaser of the product and is non-transferable.

This Limited Warranty does not cover third-party products sold by Owl, which are governed by the warranties, if any, provided by the original manufacturers of those products.

Exclusions

This Limited Warranty does not cover:

1. Wear-and-tear items, including but not limited to:

   • Powder-coated or painted surfaces showing wear due to regular use (e.g., mounting items, bags, trays, or ladders stepped on).
   • Components such as sway links or other moving parts subject to wear.

2. Damage resulting from:

   • Improper installation (self-installed or otherwise).
   • Misuse, abuse, or use outside the intended purpose.
   • Modifications or alterations to the product.
   • Normal aging or lack of proper maintenance.

3. Cosmetic defects or products sold under "Closeout" on our website.

4. Rust: Owl Vans does not warrant rust on its parts beyond sixty (60) calendar days from the date of purchase. While Owl makes every effort to protect its internally manufactured parts through methods such as dual-layer powder coating and the use of stainless steel hardware, rust is an inevitable outcome of exposure to the harsh automotive environment.

5. Improper Use:

   • This Limited Warranty shall remain valid only if the product is used strictly in accordance with its intended purpose as specified by Owl Vans.
   • Any use deemed intentional misuse, improper use, grossly negligent use, negligent use, or any other use outside the product's intended purpose shall void this warranty in its entirety.
   • Examples of improper use include, but are not limited to, loading the product beyond specified weight limits, modifying the product in a manner not authorized by Owl Vans, or using the product with vehicles for which it was not designed.

Remedy

For valid warranty claims, Owl will, at its sole discretion:

1. Repair the defective part, or
2. Replace the defective part with a new or reconditioned part of equal quality, or
3. Refund the original purchase price of the part.

The remedy provided under this Limited Warranty is the sole and exclusive remedy. Owl reserves the right to determine the appropriate remedy based on the circumstances of each claim.

How to Make a Warranty Claim

To initiate a warranty claim:

1. Contact Owl at support@owlvans.com with the subject line "Warranty Claim – [Product Name]." or call +1 888 OWL-VANS
2. Provide:
• Proof of purchase (e.g., order number, receipt).
• A detailed description of the issue.
• Photographs of the product showing the defect.
• Return of product to Owl

You are responsible for returning the defective part to Owl’s designated facility for evaluation. Owl assumes no liability for parts lost or damaged in transit. Shipping costs to and from Owl’s facility are the customer’s responsibility.

Owl will respond to warranty claims within 14 business days of receipt of all required information.

State Law Rights

This Limited Warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

Dispute Resolution

If a dispute arises regarding this Limited Warranty, Owl encourages customers to resolve it informally by contacting support@owlvans.com. If a resolution cannot be reached, disputes may be handled through arbitration or other dispute resolution mechanisms as permitted by applicable law.

Third-Party Products

Third-party products sold by Owl are not covered under this Limited Warranty. Customers are encouraged to review the warranties provided by the original manufacturers of those products. Owl provides links or written access to such warranties, where available, on the product pages of its website.

Installation Services

Owl’s installation services for its products are covered by a twelve (12) month workmanship warranty. This warranty applies only to parts purchased directly from Owl and installed at Owl facilities. Owl does not provide installation services for third-party parts not purchased through Owl.

Limitations on Liability

To the fullest extent permitted by law, Owl’s liability is limited to the repair, replacement, or refund of the defective product. Owl is not liable for consequential, incidental, indirect, or special damages, including but not limited to lost profits or revenue.

Some parts offered by Owl contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, visit www.p65warnings.ca.gov.

General Terms

• Title and risk of loss for products pass to the customer upon delivery to the carrier.
• This Limited Warranty is governed by the laws of the State of California.
• If any provision of this warranty is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Release of Liability: Aftermarket Parts 

The installation of aftermarket parts may require modifications to your vehicle. Such modifications can impact the vehicle’s performance, including but not limited to, driving characteristics, crashworthiness, and compliance with the original manufacturer’s warranty. By choosing to install aftermarket parts, you acknowledge that these parts are installed solely at your discretion and assume all associated risks.

Disclaimer: 

1. Crash and Safety Testing
• Owl and its affiliates do not conduct crash or safety testing on aftermarket parts, including bumpers or other components. These parts are not certified to meet state, federal, or international crash testing or safety requirements.
• Ensuring compliance with applicable laws and safety regulations is solely the responsibility of the purchaser.

1. Impact on Vehicle Performance and Warranty:

• Aftermarket parts may alter the performance and handling of the vehicle.
• The purchaser acknowledges that these modifications may void the manufacturer’s warranty on the parts replaced.

Assumption of Liability:

By installing aftermarket parts:

1. The purchaser assumes all liability for any modifications made to the vehicle, including any impact on its safety systems.
2. The purchaser is responsible for informing all occupants of the vehicle about the modifications to its safety systems.
3. The purchaser agrees to assume liability for any damage or injury to other vehicles, property, or individuals resulting from the operation of the modified vehicle.

Indemnification: 

The purchaser agrees to indemnify and hold harmless Owl and its affiliates, from any claims, damages, or legal actions arising from the installation or use of aftermarket parts, particularly regarding the functionality or adverse effects on the vehicle’s safety systems.

Acknowledgment of Risk: 

1. The purchaser understands and accepts that modifications to the vehicle’s safety systems are performed at their own risk.
2. All responsibility for the proper functioning of the vehicle’s systems post-modification lies with the purchaser and the original equipment manufacturer.

Agreement: If you do not agree to these terms, do not purchase or install the aftermarket parts.

Implied or Statutory Warranties

EXCEPT AS SET FORTH IN THIS POLICY, OWL EXPRESSLY DISCLAIMS ANY IMPLIED, STATUTORY OR OTHERWISE, WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND/OR FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. OWL SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES, CONDITIONS AND REPRESENTATIONS ARISING OUT OF COURSE OF DEALING, USAGE OR TRADE.

NO OTHER UNDERSTANDINGS AS TO ANY IMPLIED OR EXPRESS WARRANTY, WHETHER WRITTEN, ORAL, IMPLIED, OR OTHERWISE SHALL VARY THE WARRANTY TERMS IN THIS POLICY. ALL SUCH OWL DISCLAIMED LIABILITIES ARE HEREBY EXPRESSLY ASSUMED BY YOU, THE CUSTOMER. 

Self-Installation and Specific Parts

Customers may elect to purchase Owl-manufactured parts or third-party parts sold by Owl and undertake self-installation of those parts. However, improper self-installation may result in the failure of such parts. In the event of a warranty claim concerning an Owl-manufactured part, Owl reserves the right, upon reasonable inquiry, to determine whether improper self-installation caused the failure. If such a determination is made, the warranty for the part shall be void, and Owl shall bear no liability for any failure, damage, or related issues arising therefrom.

Owl may provide self-installation guides or instructional videos on its website, YouTube, or other platforms. Such materials are intended solely for educational purposes and as a convenience to customers. Customers are expressly advised that these materials are not a substitute for professional installation services. Owl makes no guarantees or representations regarding the accuracy, completeness, or sufficiency of such materials. Should an Owl-manufactured part fail due to improper self-installation, Owl disclaims any and all liability under this Limited Warranty or otherwise.

Additionally, most Owl-manufactured parts and third-party parts sold by Owl are designed and engineered for specific vehicle models. Customers are prohibited from installing any Owl-manufactured part or third-party part sold by Owl on a vehicle model for which it was not expressly designed or intended. Any such improper installation will void the warranty, and Owl shall not be held liable for any resulting damages or failures.

Non-Transferability of Warranty

The Limited Warranty provided by Owl Vans, LLC ("Owl") applies solely and exclusively to the original purchaser of the Owl-manufactured part ("Original Customer"). This warranty is non-transferable and does not extend to any subsequent purchaser, transferee, or assignee, whether of the Owl-manufactured part or the vehicle on which the part was installed. Any attempted transfer of this warranty, whether by sale, assignment, gift, or otherwise, shall render the warranty null and void. Owl shall have no liability or obligation under this Limited Warranty to any party other than the Original Customer.

Effect on Other Warranties

Owl Vans, LLC ("Owl") does not sell vehicles of any kind, make, or model to customers and makes no representations or warranties regarding the warranty policies of any vehicle manufacturer, original equipment manufacturer ("OEM") parts, third-party parts not purchased through Owl, or third-party parts purchased through Owl. Owl cannot claim any knowledge of or liability for the impact of installing Owl-manufactured parts or third-party parts purchased through Owl on the warranties provided by vehicle manufacturers, OEMs, or other third parties.

It is the sole responsibility of the customer to investigate and understand how the installation of Owl-manufactured parts or third-party parts purchased through Owl may affect existing vehicle or part warranties. The customer acknowledges and agrees that the installation of Owl-manufactured parts or third-party parts often necessitates the temporary or permanent removal of existing components on the vehicle. Such removal may alter the vehicle's handling, performance, or functionality in various respects.

BY CONSENTING TO THE INSTALLATION OF OWL-MANUFACTURED PARTS OR THIRD-PARTY PARTS PURCHASED THROUGH OWL, THE CUSTOMER ASSUMES FULL RESPONSIBILITY FOR ANY EFFECTS ON EXISTING WARRANTIES AND THE PERFORMANCE OF THE VEHICLE. OWL SHALL NOT BE LIABLE FOR ANY WARRANTY INVALIDATION, PERFORMANCE DEGRADATION, OR OTHER CONSEQUENCES ARISING FROM THE INSTALLATION OF SUCH PARTS.

Vehicle Registration

Van conversions often require that the vehicle converted or modified be reclassified by a given state's agency that regulates and oversees the registration of vehicles. YOU THE CUSTOMER ASSUME ANY AND ALL LIABILITIES IN THIS RESPECT.

LIMITATION OF LIABILITY & INDEMNITY – PLEASE READ

IN RECOGNITION OF THE RELATIVE RISKS AND BENEFITS OF THIS TRANSACTION BETWEEN OWL AND YOU, THE CUSTOMER, YOU EXPRESSLY UNDERSTAND AND AGREE THAT TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THAT OWL'S LIABILITY FOR ITS OWN NEGLIGENCE, FOR STRICT PART LIABILITY, FOR BREACH OF ANY APPLICABLE WARRANTY, FOR ANY CLAIM THAT THE VEHICLE’S SAFETY SYSTEMS ARE ADVERSELY AFFECTED OR DO NOT FUNCTION AS INTENDED, AND ANY OTHER DIRECT OR THIRD-PARTY CLAIM, OF ANY KIND, UNDER ANY THEORY OF LIABILITY, AND IN ANY JURISDICTION, IS LIMITED TO THE TOTAL CONSIDERATION PAID BY YOU THE CUSTOMER TO OWL.

YOU THE CUSTOMER AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS OWL, ITS DIRECTORS, OFFICERS, EMPLOYEES, ASSIGNS, ETC. FOR ANY OTHER LIABILITIES IN EXCESS OF SUCH A SUM. IN RECOGNITION OF THE RESPECTIVE POSITIONS OF BARGAINING POWER, AND AS THIS IS A DIRECT TO CONSUMER TRANSACTION, YOU THE CUSTOMER HAVE THE OPTION TO NEGOTIATE WITH OWL REGARDING THIS LIMITATION ON LIABILITY PROVISION. IF YOU THE CUSTOMER CHOOSE TO NEGOTIATE THIS PROVISION, OWL IS UNDER NO OBLIGATION TO ACCEPT ANY NEGOTIATED TERMS NOR ARE YOU THE CUSTOMER MANDATED TO ADHERE TO THE TERMS OF THIS PROVISION. BUT, IF YOU THE CUSTOMER PROCEED AND CONSUMMATE THIS TRANSACTION, YOU ARE ACCEPTING THE TERMS OF THIS PROVISION AND FOREGOING YOUR RIGHT TO NEGOTIATE THE TERMS OF THIS LIMITATION ON LIABILITY AND INDEMNITY PROVISION.
